Семејството, односно брачната заедница претставуаат основна клетка на секое здраво општество. Бракот е таков вид на заедница на лица од различен пол кој треба да создаде услови за остварување на интересите на самите брачни другари, интересите на семејството, како и интересите на општеството во целина. Посебно прашање кое привлекува внимание во делот на опстојувањето и функционирање на брачната заедница е разводот на бракот, односно нејзиното престанување преку користење на правниот институт развод. Историското анализирање на разводот на брак директно се поврзува со историската појава на бракот. За да може да стане збор за развод на брак, во претходна фаза мора да постои веќе склучен брак, односно брак кој ќе се разведе. Последиците кои настануваат како разводот на бракот може да бидат од најразлична природа. Посебен интерес привлекуваат економските последици на разводот на брак, односно оние економски последици кои директно ги погодуваат брачните другари и децата кои потекнуваат од разведениот брак, како и економските последици кои настануваат за општеството како резултат на разводот на бракот.
Abstract
The family, in the marital community are the basic cell of any healthy society. Marriage is a kind of community of people of different sexes that should create conditions for the realization of the interests of the spouses themselves, the interests of the family, as well as the interests of society as a whole. A special issue that attracts attention in the part of the survival and functioning of the marital union is the divorce, ie its termination through the use of the legal institute divorce. The historical analysis of divorce is directly related to the historical occurrence of marriage. In order for it to be a matter of divorce, in a previous phase there must be an already concluded marriage, concerning a marriage that will be divorced. The consequences of a divorce can be of various kinds. Of particular interest are the economic consequences of divorce, ie the economic consequences that directly affect spouses and children born of divorce, as well as the economic consequences for society as a result of divorce.
Abstrakt
Familja, në bashkësinë martesore është qeliza themelore e çdo shoqërie të shëndetshme. Martesa është një lloj bashkësie njerëzish të gjinive të ndryshme që duhet të krijojnë kushte për realizimin e interesave të vetë bashkëshortëve, interesave të familjes, si dhe interesave të shoqërisë në tërësi. Një çështje e veçantë që tërheq vëmendjen në pjesën e mbijetesës dhe funksionimit të bashkësisë martesore është divorci, dmth përfundimi i tij përmes përdorimit të institutit ligjor të divorcit. Analiza historike e divorcit lidhet drejtpërdrejt me ndodhjen historike të martesës. Në mënyrë që të jetë çështje divorci, në një fazë të mëparshme duhet të ketë një martesë tashmë të lidhur, në lidhje me një martesë që do të divorcohet. Pasojat e një divorci mund të jenë të llojeve të ndryshme.
