Western BalkansClass number: 364.15 Abstract: As Bogdanic and Rakic point out in this volume, hate crimes have been with us 'since the distant past'. Indeed, people acting on their racism, homophobia, disablism and religious intolerance in harmful and discriminatory ways across the world is not new. However, as the contributions to this book illustrate, the strength of the hate crime approach is that it takes a victim and community perspective that is grounded in human rights to both make visible a violence that is often hidden from public consciousness and to highlight actions that can bring victims and communities into safety, justice and the rule of law. At its best, framing and addressing this targeted violence as hate crime helps to understand it as an issue that requires action and collaboration, including passing laws, training public authorities, providing victim support and ensuring effective recording. This approach encompasses and supports diverse coalitions both across groups working to stop homophobic, Islamophobic, racist, antisemitic and disablist violence, and between civil society and public authorities. Jurisdictions with markedly different histories and contexts of discrimination have adopted the hate crime concept to varying and increasing degrees, and a canon of international human rights standards and commitments has burgeoned in recent years. While the Organisation for Security and Cooperation in Europe (OSCE) was the first to include 'hate crime' in its norms and standards, other international organisations have followed, moving from a relatively narrow focus on monitoring and addressing racist and religious violence to adopting a more global concern with 'hate crime' and the diverse violence and harm it encompasses. Civil society organisations spanning a range of groups that experience marginalisation and discrimination are increasingly relying on this growing body of international norms and standards to call for better recognition and responses to hate crime. Western BalkansClass number: 364.15 Abstract: Kao što Bogdanić i Rakić ističu u svom radu, krivična djela počinjena iz mržnje "datiraju iz daleke prošlosti". Doista, Ijudi koji reaguju napadački i na diskriminatoran način zbog vlastitog rasizma, homofobije, predrasuda prema invaliditetu ili zbog vjerske netrpeljivosti nisu ništa novo. Međutim, kao što radovi u ovom Zborniku ilustruju, značaj pristupa ovakvom nasilju kroz koncept krivičnih djela počinjenih iz mržnje je taj da on uzima u obzir perspektivu žrtve i zajednice koja se zasniva na poštivanju Ijudskih prava, a da bi se skrenula pažnja na nasilje kojeg javnost često nije svjesna i da bi se istakle reakcije koje žrtvi i zajednici mogu pružiti sigurnost, pravdu i pravnu sigurnost. U najboljem slučaju, definisanje i tretiranje ovog ciljanog nasilja kao krivičnog djela počinjenog iz mržnje doprinosi shvatanju da taj problem zahtijeva djelovanje i saradnju, uključujući tu i usvajanje zakona, edukaciju organa vlasti, pružanje podrške žrtvama i osiguravanje efikasnog evidentiranja. Ovakav pristup obuhvata i podržava rad u različitim koalicijama, kako sastavljenih od grupa koje rade na suzbijanju nasilja motivisanog homofobijom, islamofobijom, rasizmom, antisemitizmom i predrasudama protiv osoba sa invaliditetom, tako i između civilnog društva i organa vlasti. Pravosudni sistemi sa potpuno različitom historijom i kontekstom diskriminacije na različitom su, ali sve većem, nivou usvajanja koncepta krivičnih djela počinjenih iz mržnje, a korpus međunarodnih standarda i obaveza za zaštitu Ijudskih prava znatno je proširen posljednjih godina. Dok je Organizacija za sigumost i saradnju u Evropi (OSCE) prva uvrstila krivična djela počinjena iz mržnje u svoje norme i standarde, i druge organizacije su to naknadno učinile, odmičući se od relativno uskog fokusa na praćenje i reagovanje na nasilje motivisano rasizmom i vjerskom netrpeljivošću i usvajajući globalniji pristup bavljenju krivičnim djelima počinjenim iz mržnje i različitim nasiljem i štetom koju ona podrazumijevaju. Organizacije civilnog društva koje uključuju cijeli spektar grupa koje su žrtva marginalizacije i diskriminacije sve se više oslanjaju na sve veći korpus međunarodnih normi i standarda kako bi zahtijevale bolje prepoznavanje i odgovor na krivična djela počinjena iz mržnje.
