International law - Public lawClass number: 341 Abstract: This is the eighth edition of Sir Ian Brownlie's classic distillation of public international law. Serving as a single volume introduction to the field as a whole, the book seeks to present international law as a system that is based on, and helps structure, relations among states and other entities at the international level. It aims to identify the constituent elements of that system in a clear and accessible fashion. This eighth edition, fully updated by James Crawford, Whewell Professor of International Law at the University of Cambridge, continues to provide the balance, clarity and expertise expected from this classic text. Completely updated to take account of the many areas of expansion and development in international law which have occurred since earlier editions, all chapters have been reviewed and brought up to date. The eighth edition features a new introduction and the chapters on environmental law, immunities, responsibility, use of force and high seas freedoms have been substantially rewritten. It remains an important textbook for students, undergraduate and graduate, treating core issues from a lawyer's perspective. It is also a vade mecum for practitioners desiring a solid footing on which to make further enquirers. Contents note: The sources of international law; The relations of international and national law; Subjects of international law; Creation and incidence of statehood; Recognition of states and governments; International Organizations; Forms of governmental authority over territory; Acquisition and transfer of territorial sovereignty; Status of territory : further problems; The territorial sea and other maritime zones; Maritime delimitation and associated questions; Maritime transit and the regime of the high seas; Common spaces and the co-operation in the use of natural resources; Legal aspects of the protection of the environment; The law of treaties; Diplomatic and consular relations; Unilateral acts; estoppel : Succession to rights and duties; Sovereignty and equality of states; Jurisdictional competence; Privileges and immunities of foreign states; The relations of nationality; Nationality of corporations and assets; The conditions for international responsibility; Consequences of an internationally wrongful act; Multilateral public order and issues of responsibility; The international minimum standard : persons and property; International human rights; International criminal justice; The claims process; Third-party settlement of international disputes; The use of threat of force by states; Record link: https://library.seeu.edu.mk/index.php?lvl=notice_display&id=15698 Hold

Newly independent states
Sovereignty
State successionClass number: 341.26 Abstract: Statehood in the early 21st century remains as much a central problem now as it was in 1979 when the first edition of The Creation of States in International Law was published. As Rhodesia, Namibia, the South African Homelands and Taiwan then were subjects of acute concern, today governments, international organizations, and other institutions are seized of such matters as the membership of Cyprus in the European Union, application of the Geneva Conventions to Afghanistan, a final settlement for Kosovo, and, still, relations between China and Taiwan. All of these, and many other disputed situations, are inseparable from the nature of statehood and its application in practice. The remarkable increase in the number of States in the 20th century did not abate in the twenty five years following publication of James Crawford's landmark study, which was awarded the American Society of International Law Prize for Creative Scholarship in 1981. The independence of many small territories comprising the 'residue' of the European colonial empires alone accounts for a major increase in States since 1979; while the disintegration of Yugoslavia and the USSR in the early 1990s further augmented the ranks. With these developments, the practice of States and international organizations has developed by substantial measure in respect of self-determination, secession, succession, recognition, de-colonization, and several other fields. Contents note: Statehood and recognition; The criteria for statehood : statehood as effectiveness; International law conditions for the creation of states; Issues of statehood before United Nations organs; The criteria for statehood applied : some special cases; Original acquisition and problems of statehood; Dependent states and other dependent entities; Devolution; Secession; Divided states and reunification; Unions and federations of states; International dis-positive powers; Mandates and trust territories; Non-self-governing territories : the law and practice of decolonization; The commencement of states; Problems of identity, continuity and reversion; The extinction of states.
