Law Class number: 345 Abstract: The purpose of this study is to examine the introduction, institutionalization and development of provisional. Interim measures of protection under International Law. The Scope of the study covers a period of more than a century, (1907-2010). In the analysis of the institution of provisional measures, three main problematic areas can be identified. The first is related to the basis and scope of the “competence” for the indication provisional measures decisions. This question also covers the determination of the international judicial authority which decides on the interim measure. The second is focused on the question of whether the “provisional measures decision” is of a legally binding nature and if so, under which category such decisions are classified. In other words, the essence of the problem is that, in respect of the State Party concerned, whether the observance of an interim measure decision can only be considered as a moral or customary duty or as a legal obligation. The third problematic area, which is closely connected with the second, is related to the legal consequences of noncompliance with the indicated provisional measures; namely whether noncompliance with interim measure decisions may lead to a violation of obligations by the State concerned.
